Legal Information

Nebraska Education Code For Homeschooling
AN A TO Z RESOURCE
Not intended as legal advice. For your information only.

Affidavit to Delay Entry into an Exempt School
State law requires compulsory school attendance if the student is 6 years of age before January 1 of the school year for which Rule 13 or Rule 12 forms are filed. Parents can delay the start of homeschooling until age seven (7) by filing an affidavit with the local school district.

Exempt (Home) Schools
In Nebraska, "home schools" are referred to as exempt schools.  By State Statute, they are referred to as non-approved or non-accredited schools. On this site you will find information pertaining to the law affecting exempt schools, the rules and regulations, frequently asked questions, exempt school resources, and the forms used to file for an exemption.

Exempt School Forms For this School Year
Before viewing or printing the forms to file for an exemption for the school year, please review the Important Filing Information on this page.

Legal Questions About Homeschooling in Nebraska
NCHEA's answers to frequently asked questions regarding the legal aspects of homeschooling in Nebraska.

Rules & Regulations
Rule 12 and Rule 13 are the rules governing the procedures and standards for parents filing for an exemption. Rule 12 and Rule 13 are the same with the exception of the reason for the exemption and that Rule 12 exempt schools will need to comply with immunization laws.

Rule 12
This Chapter provides rules and regulations governing the procedures for exemption of schools from state approval and accreditation requirements when such schools elect, pursuant to Section 79-1601 R.R.S., not to meet those requirements because they interfere with the decisions of the parents or legal guardians in directing their child's education. Forms on pages 7 and 8 of linked pdf file.

Rule 13
This Chapter provides rules and regulations governing the procedures for exemption of schools from state approval and accreditation requirements when such schools elect, pursuant to Section 79-1701(R.R.S.), not to meet those requirements because they would violate the sincerely held religious beliefs of the parents or legal guardians.
